They sent him back to India with his eardrums pierced with hot rods, eyes punctured and removed, most of his teeth and bones broken, and limbs and genitals cut or chopped off. 
Capt. Saurabh Kalia, of the 4 Jat Regiment, was captured by Pakistani troops along with five other Indian soldiers on May 15, 1999. He was held in captivity and tortured gruesomely, but the brave soldier did not betray his motherland. 

When their bodies were handed over to India by the Pakistan Army on June 9 the same year, there was nation-wide outrage and a cry for justice against the way these prisoners of war were treated, in violation to the Geneva Convention on treatment of war prisoners. 

Sixteen years from then, the government of the day - the same government that had mouthed muscular rhetoric against Pakistan - has said in Parliament that it is not feasible for India to pursue the matter in the international court of law. 
Even after a video, which went viral on YouTube a year ago, of a Pakistani soldier admitting that the 32-year-old Indian Army officer was tortured and killed during the 1999 Kargil war which took place when the Vajpayee-led government was in power, the Modi government has now decided to bury the case. It claims moving the International Court of Justice (ICJ) against Pakistan, a demand made by Kalia’s father in the Supreme Court, will not be practicable. 

Even as PM Narendra Modi speaks up on the radio for the brave, unsung soldier risking his life and limb at the border, his government has towed the line of the UPA regime on the Kalia issue. 
This comes a blow not only to the 66-year-old N.K. Kalia, who has been running from pillar to post for the past 16 years to secure justice for his son, but also all Indians who want justice for the hero of the 1999 war, who first reported large-scale incursions by the Pakistan Army.
The UPA government had told the Supreme Court in February last year that it cannot move the ICJ as Pakistan might not permit it, and no country can be so compelled to. 
The Manmohan Singh government also shockingly went to the extent of saying that the effect on relations with “our neighbor country” has to be kept in mind, and that “moving the ICJ is not a legally enforceable right”.

To Chandrashekhar’s question on whether the government proposed to take up the killing of Saurabh and five other soldiers by the Pakistan army with the United Nations Human Rights Commission, and move the ICJ to pressurize Pakistan to identify and punish all perpetrators, Singh had recently replied: “The attention of the international community has already been drawn to these heinous and barbaric acts of Pakistan army including through a statement to the UN general assembly in New York on September 22, 1999, and to the Commission of Human Rights in April 2000. The  possibility of seeking legal remedies through the international courts was also thoroughly examined, but not found feasible.”
The Supreme Court has now asked the Modi government to make its stand clear through an affidavit by August 25, the next date of hearing. 

N.K. Kalia had moved the Supreme Court in 2012 seeking a direction to MEA to approach the ICJ for action against Pakistani army men who killed his son in violation of ‘Geneva Convention on treatment of war prisoners’.
The court has been repeatedly snubbing the MEA, saying it had surrendered even before filing the case. 
“It would have been more befitting had the government approached the ICJ with all proofs and documentary evidences and might have lost,” said the SC.
"The video proved my son did not die due to bad weather but was killed in the hands of his captors. He was tortured. It is surprising that the Centre has not considered the new evidence which has come on record, and still goes by Pakistan version," said a distraught Kalia. 
Going soft

It is not just an issue of my son, but no other Indian soldier shall be treated like this. There should be a deterrent,” he said, adding that he will submit CDs of the Pakistani soldier’s TV confession to the apex court.
Kalia's lawyer, Arvind Kumar Sharma, told : “This is a fit case to be referred to the ICJ as the torture is a clear violation of Geneva Convention on treatment of war prisoners. Pakistan has dragged India many times to the ICJ, then why cannot we do the same on the issue? Rows between India and Pakistan may be governed by the Simla pact under which they are to be settled bilaterally, but in such issues India is definitely not going to get justice and it has to be taken to the international court."

नई दिल्ली. केंद्र में मोदी सरकार कारगिल युद्ध के दौरान शहीद हुए सौरभ कालिया सहित पांच भारतीय जवानों को न्याय दिलाने के पक्ष में नहीं है। सरकार ने पिछले दिनों संसद में एक प्रश्न के जवाब में स्पष्ट कर दिया कि फिलहाल इस मुद्दे को इंटरनेशनल कोर्ट में नहीं उठाया जाएगा। बता दें कि 1999 में कारगिल युद्ध के दौरान सीमा पर 4 जाट रेजिमेंट के कैप्टन सौरभ कालिया सहित पांच जवानों को पाकिस्तान सैनिकों ने बंदी बना लिया था और उनके साथ अमानवीय सलूक किए गए थे जिनके कारण उनकी मौत हो गई थी। इसके बाद से शहीद के परिवार वाले पाकिस्तान के सैनिकों के खिलाफ कार्रवाई की मांग कर रहे हैं। 

संसद में सवाल और सरकार का जवाब
सांसद चंद्रशेखर ने संसद में सवाल पूछा था कि क्या सरकार सौरभ और पांच अन्य भारतीय सैनिकों की पाकिस्तानी सेना द्वारा हत्या मसले को युनाइटेड नेशंस के मानवाधिकार आयोग के समक्ष उठाएगी? क्या इस मामले पर आईसीजे का दरवाजा खटखटाया जाएगा, ताकि दोषी पाकिस्तानी सैनिकों सजा दी जा सके। सवाल के जवाब में सरकार की ओर से केंद्रीय मंत्री वीके सिंह ने कहा था, ''इस मासले से अंतरराष्ट्रीय समुदाय को न्यूयॉर्क अधिवेशन के दौरान 22 सितंबर 1999 को और मानवाधिकार आयोग को अप्रैल 2000 में ही
अवगत करा दिया गया है। अंतरराष्ट्रीय कोर्ट के जरिए कानूनी कार्रवाई के बारे में भी सारे पहलुओं पर विचार किया गया लेकिन यह संभव नहीं लगता।''

सुप्रीम कोर्ट में अपील कर चुके हैं सौरभ के पिता
सौरभ कालिया के पिता एनके कालिया ने 2012 में सुप्रीम कोर्ट का रुख किया। उनकी मांग है कि विदेश मंत्रालय इस मसले को इंटरनेशनल कोर्ट ऑफ जस्टिस में उठाए ताकि जिन पाकिस्तानी जवानों ने उनके बेटे की हत्या की उनके खिलाफ कार्रवाई हो सके, क्योंकि इस प्रकार का बर्ताव यह युद्ध बंदियों के साथ जेनेवा कन्वेंशन का उल्लंघन है। सौरभ के पिता एनके कालिया 16 साल बाद भी अपने बेटे के लिए न्याय के लिए लड़ाई कर रहे हैं। 

यूपीए सरकार का स्टैंड
यूपीए सरकार ने पिछले साल सुप्रीम कोर्ट में कहा था कि आईसीजे (इंटरनेशनल कोर्ट ऑफ जस्टिस) में अपील नहीं की जा सकती क्योंकि पाकिस्तान सुनवाई के लिए राजी न हो और किसी देश को इसके लिए बाध्य नहीं किया जा सकता। सरकार ने कहा था कि पड़ोसियों के साथ रिश्तों को ध्यान में रखते हुए आईसीजे में जाना कानूनी रूप से वैध नहीं होगा। 16 साल बाद भी एनडीए सरकार पाकिस्तान के खिलाफ इंटरनेशनल कोर्ट ऑफ जस्टिस में अपील करने को लेकर गंभीर नहीं है। सरकार संसद में कह चुकी है कि अंतरराष्ट्रीय स्तर पर इस मुद्दे को उठाना संभव नहीं है।

सौरभ कालिया के साथ दरिंदों जैसा बर्ताव करने वाले पाकिस्तानी सैनिकों ने इसे स्वीकार किया था। इसका वीडियो सालों से यूट्यूब पर पड़ा है। बावजूद इसके मोदी सरकार पिछली सरकार के स्टैंड को ही आगे कर चल रही है। एनके कालिया का कहना है, ''मैंने उम्मीद लगाई थी कि बीजेपी सरकार ज्यादा देशभक्त है। लेकिन दुख के साथ कहना पड़ रहा है कि नई सरकार भी पुरानी सरकार के स्टैंड पर कायम है। सांसद राजीव चंद्रशेखर द्वारा संसद में पूछे गए सवाल पर विदेश मामलों के राज्य मंत्री वीके सिंह के बयान से स्पष्ट है कि नई सरकार भी कारगिल के शहीदों को न्याय दिलाने के पक्ष में नहीं है।''

New Delhi: A video taken during a Pakistani army function reportedly shows a soldier sharing details of an encounter in which Captain Saurabh Kalia, and five of his platoon members, were killed in 1999 just before the Kargil war broke out. The video clip has been uploaded on YouTube.
Captain Kalia and other soldiers were captured by Pakistan and allegedly tortured brutally during the war that lasted from May to July in 1999.
23-year-old Captain Kalia of the 4 Jat Regiment was the first Indian Army officer to observe and report large-scale intrusion by the Pakistani Army into the Indian side of the Line of Control in the Kargil sector of Jammu and Kashmir. He and the five others were captured on May 15, 1999 and were in captivity for more than 20 days.

When their bodies were handed over to India, the autopsy reports revealed extreme torture including cigarette burns, ear drums pierced with hot iron rods and amputated limbs.
"The Army has admitted to the encounter in mid-May 1999. All through these years, right from their ex-President Musharraf to any of their Generals, they have never admitted that this incident happened," said Captain Saurabh Kalia's father, NK Kalia.
NK Kalia had earlier said that though Pakistan's handling of his son violates the international convention on the treatment of prisoners of war, the Indian government has been apathetic in not raising the case with Pakistan.

Captain Kalia's father said that he had first approached the Indian Defense Ministry for help, which said his son's case had been referred to the Prime Minister's Office, which in turn said the matter was being studied by the External Affairs Ministry.

He wants the Indian government to raise the matter with the International Court of Justice. In December, the Supreme Court had asked the government to explain whether it will take the case of the Kargil martyr to the International Court of Justice at The Hague.
